Terms & Conditions

RETAINER OF SERVICES: MorningStar Luxury Travel actively markets and operates a Professional Travel Planning Service to the General Public and all Bookings including but not limited to Group Contracts; Corporate Travel; Air Travel; Cruise Travel; Family Leisure Travel are voluntary and at the direction of Client. 

SCOPE OF WORK: Client authorizes MorningStar Luxury Travel and its associates to perform duties including but not limited to planning; management; modification; cancellation; emergency in-travel booking; on behalf of the authorizing party and their immediate traveling companions included on any booking(s) under this agreement. 

PAYMENTS: All payments are remitted directly through the vendor/supplier. MorningStar Luxury Travel does not hold any monies, deposits, or final payments. All transactions and timing are subject to the discretion of the supplier.

REFUNDS: Client agrees and acknowledges refunds resulting from but not limited to booking modifications; cancellations; promotions; are processed in accordance with the accounting practices of various Third-Party Vendors contacted to complete the actions described in this agreement. Client agrees to withhold initiation of any Credit Card dispute; Chargeback; or other recovery tools allowed by their individual Credit Card issuer until such action is written and mutually agreed to between MorningStar Luxury Travel and Client; or after 180 days has elapsed from written notification of pending refund.

PRICING: All pricing and availability are subject to change until invoice has been approved, booked, confirmed by agency and deposit has been processed.

INTERNATIONAL TRAVEL BY AIR: All travelers, including children and infants, MUST have a VALID Passport Book to travel internationally. Passport Cards are NOT an acceptable form of Identification for International Air Travel. Failure to comply may result in denial of boarding and may result in additional monies due for rebooking, penalties and fees.  MorningStar Luxury Travel is NOT responsible for acquiring passports, mistakes, modifications needed, or lost or damaged passports. Many foreign countries require your passports to be valid for 6 months from your return date. It is the traveler's responsibility to confirm this policy on www.travel.state.gov . Even for countries where this law is not enforced, we highly recommend that our clients maintain passports that are valid 6 months following return date.


PASSPORT CARDS ARE NOT VALID FOR INTERNATIONAL TRAVEL VIA AIR!

INTERNATIONAL TRAVEL BY CRUISE SHIP: MorningStar Luxury Travel strongly recommends Passports for all travelers traveling by cruise ship, although not required. Passports are not required for sailings departing and returning to the same port within the United States of America. Should you choose to not travel with a passport, a CERTIFIED BIRTH CERTIFICATE (not a photo copy) will be required for each traveler, including infants. For sailings in which the cruise originates and ends in different ports of call, passports are required.

DOMESTIC TRAVEL BY AIR: All travelers, ages 16 and above are required to show a valid government issued ID to board domestic flights. Example: State Driver's License

You may also present a valid passport for domestic travel. If you are traveling with a child under the age of 2 years old, and the child is traveling as a lap child, the airline may require you to present proof of age of the child. A birth certificate would be appropriate for proof of age in this situation. MorningStar Luxury Travel strongly recommends that parents with children under the age of two travel with a birth certificate.

STAR ID REQUIRED: Beginning May 3rd, 2023 all domestic flights will require flyers to hold a STAR ID or possess a passport. To see a list of all accepted documents visit the TSA website. Some military installations are currently requiring a STAR ID to obtain access, it will depend on the facility. Please visit your state's motor vehicle website for details on how to acquire your STAR ID for domestic travel.

CHANGES TO RESERVATIONS: ANY changes made to your existing reservation are subject to the current rates, promotions, and terms at the time of change. Change fees may occur and application of promotions, if applicable, may be void. 

CANCELLATION PENALTIES: All reservations made by MorningStar Luxury Travel may be subject to a cancellation fee. Airline tickets booked by MorningStar Luxury Travel are 100% non-refundable and subject to individual airline penalties/fees. In the event you cancel your trip after deposit has been processed, the reservation will be subject to the supplier's cancellation fees and penalties. Cancellation policies are subject to change at any time. MorningStar Luxury Travel reserves the right to treat the booking as cancelled if the balance due is not paid on time. Travel insurance may be non-refundable after the policy is purchased.

TRAVEL PROTECTION POLICY: MorningStar Luxury Travel will provide you with a travel protection policy quote once a package has been selected. Your policy must be purchased within 14 days from the date of deposit in order to receive the full coverage, including pre-existing condition waivers. Travel Protection Quote does NOT cover items you purchase outside MorningStar Luxury Travel, such as airfare, tours, excursions, etc, unless the traveler requests that those items be quoted within the policy. Travel protection policies may be non-refundable after the policy is purchased. All insurance claims are to be filed by the customer directly with the insurance company.  MorningStar Luxury Travel is not responsible for denied claims.

TRAVELING WITH MINORS: Children under 18 years of age not traveling with both parents or legal guardian(s) may need to present a notarized letter from the absent parent/guardian granting permission to travel outside the United States and provide emergency medical care if necessary.

CRIMINAL HISTORY: Criminal history including a DUI or back child support payments may cause you to be denied entry to some countries. Please advise your agent before cancellation penalties begin if this may apply to you, as being denied boarding/entry for these reasons is not covered by Travel Insurance Protection policies.

MorningStar Luxury Travel is not responsible for lack of compliance in providing proper documentation to airport authorities. It is the responsibility of the traveler and the traveler's parents/guardians to provide proper documentation to airport authorities.

 CORRESPONDENCE: Client is responsible for confirming all information contained within all correspondence including but not limited to Booking Confirmations; Travel Documents; Schedule changes; Modifications; Trip Protection; Etc. MorningStar Luxury Travel MUST be notified in writing within 24 hours of any errors contained within any written correspondence including but not limited to; Spelling; Passengers; Airlines; Cities; Hotels; Tours; Dates; Etc. Errors are not the responsibility of MorningStar Luxury Travel, if notice of the above are not given to your advisor within 24 hours of receipt of your invoice. 

TRAVEL DOCUMENTATION: Included in your travel documents (if airfare is purchased through MorningStar Luxury Travel) are airline electronic ticket receipts (proof of purchase, not boarding passes or actual tickets). Boarding passes are printed at the time of the online check in with the airline directly or at the airport when showing passport & checking in luggage. It is very important that you take your travel documents with you, in addition to passports and a major credit card for any baggage fees that may apply.

BAGGAGE FEES: Due to continual changes in airline baggage policies it is suggested that you review your airline's website for up-to-date fees & information. MorningStar Luxury Travel is NOT responsible for additional fees incurred for baggage or seating. Please review "Updated Checked Bag and Carryon Bag Rules" at

AIRLINE SCHEDULE CHANGES & CANCELLATIONS: Airlines may modify and cancel flight reservations at ANY TIME. These changes are beyond MorningStar Luxury Travel's control. In the event that such a situation occurs, MorningStar Luxury Travel will assist in securing possible alternate option(s). If the flight time modification is what the airline has determined as "minor" (2 hours or less) the airline will automatically make the change (airline policies/rules entitle them to legally do so).  MorningStar Luxury Travel will notify you of major changes as we are notified by the airline.

Please Note: there may be additional costs to re-book a new flight should the airline cancel or make a major change to your original flight itinerary. MorningStar Luxury Travel is NOT responsible for any additional costs or fees imposed by the airlines. It is the responsibility of the passenger to check for last minute airline flight time changes within 24 hours of departure. MorningStar Luxury Travel is not responsible for changes that may occur with the original flight departure time.

RECONFIRM YOUR FLIGHTS: MorningStar Luxury Travel advises you to re-confirm your flight schedule within 24 hours prior to departure directly with the airline in case of any last minute changes or delays. Most airlines allow you to check in online 24 hours prior to departure using the airline confirmation number (found in your MorningStar Luxury Travel documents).

AIRLINE CHECK IN AND AIRPORT ARRIVAL: Online CHECK-IN can be completed up to 24 Hours prior to departure or in person at your airport of departure. Airline policy STRONGLY encourages passengers to ARRIVE at the airport no later than 2 Hours prior to departure for Domestic travel and a minimum of 3 Hours prior to departure for international travel. Late arrivals to Airport can result in denied boarding without compensation. Third party cancellation fees and fare changes may be incurred and are the sole responsibility of Client. 

CHECKING IN AT YOUR DESTINATION: Each resort, cruise line, hotel, etc have varying check-in times. Please note that if you arrive prior to check in time, your luggage can be held safely at the bell hop desk, and you can enjoy the amenities prior to your room being available. Cruise lines may require for carry-on luggage to remain on your person until room check in is available. Please be aware of your destination's check in time prior to travel. Travelers will be required to show a valid form of identification, either Driver's License or Passport, when checking in at your resort. Travelers will also be asked to provide a major credit card for incidental purchases during your stay.

RISKS/ FORCE MAJEURE: Customer acknowledges that travel to any destination includes certain risks, dangers, and perils. Force Majeure events include without limitation (a) acts of God; (b) a natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms, explosions, infestations), epidemic, or pandemic; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of this Agreement; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; and (i) shortage of adequate power or transportation facilities. 

Such Risks are unavoidable, and MorningStar Luxury Travel disclaims any and all liability for harm to Customer related to such Risks. Customer agrees to waive any claims against MorningStar Luxury Travel for the Risks and to hold harmless, defend and indemnify (including reasonable attorneys’ fees) MorningStar Luxury Travel for any claims or liabilities arising from or related to such Risks, to the fullest extent permitted by law.

COVID RELEASE AGREEMENT

The 2019 Novel Coronavirus* (COVID-19, “Coronavirus”) is a known and rapidly evolving pandemic that is affecting travel worldwide, with continued spread and impacts expected.

Client is fully aware of the current global Coronavirus COVID-19 virus outbreak, the current travel restrictions, and inherent risks involved if choosing to travel.

Client understands that it is his/her responsibility to check the latest travel information regarding this virus outbreak with the CDC.

Client understands that it is his/her responsibility to have travel insurance to ensure they have coverage for all medical needs and trip cancellation, but understands that concerns or fear of travel is not a covered reason for cancellation relating to the Coronavirus/ Covid-19 and will be denied. Client holds MorningStar Luxury Travel and its agents harmless for his/her election to not purchase travel insurance or any denial of claim by travel insurer as it relates to Covid-19 or any other claim under the policy.

Travel protection generally only covers unforeseen events. Most insurers classified COVID-19 as a 'known event' late January 2020. Please note that most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. Client understands that he/she is bound by the terms of the insurance policy as it relates to Coronavirus/Covid-19.

Client is aware of the travel warnings, travel restrictions and rules and understands the risks, is accepting of these and holds MorningStar Luxury Travel harmless for any travel restrictions, death, illness, cancellations by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider, financial loss, quarantining rules or measures put in place at airports or destinations you are traveling through. Client further agrees to hold MorningStar Luxury Travel and their agents harmless for any financial penalties or fees imposed by the by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider due to cancellations or postponements due to Covid 19 and agrees not to institute a credit card dispute or “charge back” to MorningStar Luxury Travel and their agents for said penalties or fees.

Client is aware that additional screening procedures and restrictions may take place at airports and in public areas. Client is aware that these restrictions may include mandatory face coverings and/or temperature checks in airports, hotels, cruise ships, trains or other means of transport.

Client is aware that Immigration restrictions may be put in place before or during your travels that may impede your ability to enter or exit your destination as planned.

Client is aware that it is his/her personal decision to travel and is doing so with full knowledge of current travel recommendations and travel restrictions with regards to the Coronavirus COVID-19 and takes full responsibility for his/her actions with regards to this.

Client understands and confirms that MorningStar Luxury Travel and their agents, after reasonable inquiry, has provided client with the best available information regarding pandemic protection policies provided by travel suppliers, including but not limited to airlines, hotels, cruises lines, tour agencies, transfer agencies or any other provider involved in clients booking, but that said suppliers may not enforce or apply said policies.
Additionally, client understands and is aware that even if said travel suppliers make a good faith effort to enforce said pandemic policies and procedures, some travelers may refuse to cooperate with said policies. Client further holds MorningStar Luxury Travel and their agents harmless for any injury or harm that may arise.

In consideration of the opportunity afforded to me and with full knowledge and acceptance of the risks associated with travel, I hereby release, indemnify, hold harmless and covenant not to sue MorningStar Luxury Travel and their agents, its officers, employees, volunteers, agents, representatives, and any other person involved either directly or indirectly, from all claims, suits, expenses, attorney fees and demands of any nature (including negligence) caused by, deriving from, or associated with this vacation. I make these covenants, release and waivers knowingly and voluntarily. It is further understood and agreed that this Coronavirus/Covid 19 Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement is to be binding on my heirs and assigns and I sign it of my own free will.


By authorizing consent for MorningStar Luxury Travel to process your initial deposit, you confirm that the reservation information, itinerary, dates, and passenger information are correct and that you accept our terms and conditions outlined above.
